There are two types
of LPA:

  • Personal Welfare LPA
    for health and personal welfare decisions, and
  • Property and Affairs LPA for property and financial affairs

Wills and Lasting Powers of Attorney
and Court of Protection

Making a Will allows you to ensure that your assets are passed on after your death as you choose. It can also prevent your beneficiaries from paying unnecessary taxes and you can deal with other important factors such as guardianship for minors, payment of debts and funeral expenses amongst others.

We can also provide advice on Lasting Powers of Attorney (LPA) which came into force on 1st October 2007 and replaced the Enduring Power of Attorney.

The LPA is a legal document that allows you (the Donor) to appoint a specified person (the Attorney) to deal with your property and affairs or personal welfare on your behalf.

You may wish to have an LPA drawn up because you want to allow somebody you trust to make decisions on your behalf when you are no longer able to do so for yourself for whatever reason or if you lack the mental capacity to make such decisions.

The LPA can be drawn up at any time while you have capacity, but has no legal standing until it is registered with the Office of the Public Guardian and you can cancel it if you have necessary capacity.
